1. Agreement to Terms
This website is operated by TEN2. By accessing our website or purchasing from us, you agree to be bound by these Terms & Conditions, including all policies referenced herein.
If you do not agree, you must not use this website or any services.
TEN2 reserves the right to update or modify these Terms at any time. Continued use constitutes acceptance of changes.
2. Nature of Service
TEN2 supplies made-to-order, custom-manufactured furniture and design products.
All orders are:
- project-based commissions
- manufactured specifically upon confirmation
- not standard retail stock
3. Order Acceptance
An order is only confirmed when TEN2 has received:
- deposit payment
- confirmed specifications
- written approval of design (where applicable)
TEN2 reserves full discretion to accept or reject any order prior to production.
4. Pricing & Availability
All prices are:
- in AUD
- inclusive of GST
TEN2 reserves the right to:
- change pricing without notice
- discontinue products
- correct pricing errors after order submission
If correction is required, the client may choose to proceed or cancel prior to production.
5. Production Disclaimer
All production timelines (including 14–18 weeks estimates) are indicative only.
TEN2 is not liable for delays caused by:
- material availability
- supply chain disruption
- workshop scheduling
- third-party logistics
6. Design Approval & Responsibility Transfer
Where drawings, specifications, or approvals are provided:
- client is solely responsible for final verification
- approval confirms full acceptance of all details
TEN2 bears no responsibility for:
- measurement errors after approval
- design misinterpretation
- site incompatibility
7. Cancellation Policy (Critical Clause)
Before production begins:
- cancellation may be accepted at TEN2’s discretion
- deductions may apply (design, admin, materials ordered)
After production begins:
👉 Orders are strictly non-cancellable and non-refundable
Production commencement includes:
- material procurement
- workshop allocation
- cutting or fabrication
8. Delivery & Risk Transfer
Delivery is complete when goods arrive at the nominated address.
Risk transfers immediately upon delivery.
TEN2 is not responsible for:
- on-site handling damage
- installation or placement
- third-party interference
9. Site Conditions Responsibility
The client is fully responsible for ensuring:
- access suitability
- dimensional clearance
- lift capacity
- safe delivery conditions
TEN2 does not inspect or guarantee site suitability.
10. Returns & Refunds
All custom-made goods are:
👉 strictly non-returnable and non-refundable
Refunds are only provided where required under Australian Consumer Law.
11. Faults & Claims
Claims must be submitted within 24 hours of delivery.
TEN2 will determine whether the issue is:
- manufacturing defect
- natural material variation
- site or handling damage
Only confirmed defects qualify for remedy.
12. Exclusions
Not considered defects:
- natural material variation
- colour/texture differences
- minor dimensional tolerance
- ageing or patina
- environmental effects
13. Warranty
TEN2 provides a 12-month limited warranty covering manufacturing defects only.
Excludes:
- wear and tear
- misuse
- environmental damage
- commercial use (unless agreed)
- modifications by third parties
- outdoor exposure (unless specified)
14. Limitation of Liability
TEN2 liability is strictly limited to:
- repair
- replacement
- or refund (where legally required)
TEN2 is not liable for:
- indirect loss
- project delays
- installation costs
- third-party expenses
15. Intellectual Property
All content, designs, drawings, and materials remain TEN2 property unless otherwise agreed in writing.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
17. Entire Agreement
These Terms constitute the entire agreement between TEN2 and the client.
